Samantha Elizabeth Rothwell appeals from a judgment after a jury
convicted her of second degree murder and found true she personally used a
deadly or dangerous weapon, a knife, in the commission of the crime. Rothwell
argues her federal constitutional rights were violated when the trial court
refused to instruct the jury to consider evidence of her intoxication in
determining whether she acted with conscious disregard for human life. We
disagree and affirm the judgment.

Defendant was on Paxil, an anti-depressant drug, and had a few
drinks after playing golf. He was arrested and charged with DUI after
weaving through traffic. He was “obviously impaired” according to his
lawyer. “The worst I’d ever seen in 25 years.”

A man accused of murdering his
Vodafone executive wife has told a court the pair traded swipes with knives
after she admitted having an affair.
Sally Sinclair, 40, was found
with more than 30 stab wounds at their home in Amport, Hampshire, in August
2008.

A man who bludgeoned his partner
to death with a lump hammer while in the grip of psychosis has been told he may
never be released from jail.
Paul Ford, aged 51, told police he thought
he had hit mother-of-five Debra Ford “hundreds and hundreds and hundreds” of
times in the face at the home they shared in Oldland Common.

Two men were filmed rolling about on the ground outside a Stroud nightclub at 2.30am while a distraught woman tried to break them up.
The CCTV footage was shown to city magistrates this week.
Adam Belcher, of Bisley Old Road, Slad, pleaded guilty to assault when he appeared at the court on Wednesday.
The incident occurred outside 13 nightclub in Nelson Street on July 25.
